1. About Us

Oralytics Limited (“Oralytics”, “we”, “us”, “our”) is a company registered in England and Wales with Companies House.

We operate an online analytics and data platform providing insights related to NHS dental activity and associated datasets.

2. Acceptance of These Terms

By accessing or using the Oralytics website, platform, or services (the “Service”), you agree to be bound by these Terms and Conditions.

If you do not agree, you must not use the Service.

3. Eligibility

You must:

  • Be at least 18 years old, and
  • Have the legal authority to enter into a binding contract

If you are using the Service on behalf of an organisation, you confirm that you are authorised to bind that organisation to these Terms.

4. The Service

Oralytics provides access to data analytics, visualisations, rankings, and insights derived from publicly available NHS datasets, including data sourced from the NHS Business Services Authority (“NHSBSA”).

We may update, modify, suspend, or discontinue any part of the Service at any time without notice.

5. Data Sources and Accuracy

  • Data is sourced from third parties, including the NHSBSA.
  • Oralytics does not independently verify this data.
  • We do not guarantee that the data is accurate, complete, up to date, or suitable for any particular purpose.
  • You acknowledge that errors, omissions, delays, or inconsistencies may exist.

The Service is provided for informational and analytical purposes only and must not be relied upon as professional, financial, legal, or clinical advice.

6. Accounts and Access

To access paid features, you must create an account and provide accurate and up-to-date information. You are responsible for:

  • Maintaining the confidentiality of your login details
  • All activity that occurs under your account

We may suspend or terminate accounts that breach these Terms.

7. Subscription, Fees, and Payment

7.1 Subscription Model

Access to full features requires an active paid subscription. Subscriptions are billed monthly in advance. There is no minimum contract length.

7.2 Cancellation

You may cancel your subscription at any time. Cancellation prevents future renewals. You will continue to have access until the end of the current billing period plus 28 days.

7.3 Refunds

No refunds are provided for the current billing period once payment has been made, including partial months.

7.4 Payments and Stripe

Payments are processed by our third-party payment processor, Stripe. Oralytics does not store or process your card or payment details. Payment processing is subject to Stripe’s own terms and conditions.

8. Free, Trial, or Limited Access

We may offer limited, trial, or preview access at our discretion. Such access may be withdrawn or restricted at any time without notice.

9. Intellectual Property

All intellectual property rights in the Service, including software, design, text, charts, branding, and analytics models, are owned by or licensed to Oralytics Limited.

You may: View and use the Service for your internal business or personal purposes only.

You must not:

  • Copy, scrape, download, resell, redistribute, or republish the data or content
  • Use automated tools to extract data
  • Reverse engineer or attempt to access underlying systems or databases

10. Acceptable Use

You agree not to:

  • Use the Service unlawfully or fraudulently
  • Interfere with or disrupt the Service
  • Attempt to bypass access controls or subscription restrictions
  • Misrepresent Oralytics data as official NHS or NHSBSA output

11. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, including accuracy, reliability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the fullest extent permitted by law:

  • Oralytics shall not be liable for any indirect, incidental, special, or consequential losses.
  • We are not liable for loss of profits, revenue, business, data, or goodwill.
  • We are not liable for decisions made based on the Service or its data.
  • Our total liability in any 12-month period shall not exceed the total subscription fees paid by you during that period.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.

13. Indemnity

You agree to indemnify and hold harmless Oralytics Limited from any claims, damages, losses, or expenses arising from your use of the Service, your breach of these Terms, or your misuse/misinterpretation of the data.

14. Privacy and Data Protection

Use of the Service is also governed by our Privacy Policy. We process personal data in accordance with UK GDPR and applicable data protection laws.

15. Third-Party Services and Links

The Service may include links to third-party websites or services. We are not responsible for their content, availability, or terms.

16. Termination

We may suspend or terminate your access immediately if you breach these Terms, if required by law, or if your use poses a risk to the Service. Termination does not affect accrued rights or outstanding fees.

17. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute.
